Last Will and Testament of John Baptiste Mosbacher; filed and submitted December 2, 1871 Book B, page 78, Monroe County, Illinois “In the name of God, Amen. I, John Babtist [sic] Mosbacker [sic] of Columbia, Monroe County, State of Illinois, of the age of seventy five /75/ years, being of sound mind and memory; do make, publish and declare this my last will and testament, hereby revoking all former wills by me made, in manner following, that is to say: First: It is my will that my funeral expenses and all my just and lawful debts are fully paid. Second: I give and bequeath to the heirs of my daughter Elisabeth Smith [sic] deceased, wife of Philipp Schmidt, the sum of five dollars, having hereby taken in consideration the amount of money which she has already received in her lifetime. Third: I give and bequest to my beloved wife Margaretha Mosbacher [sic] all my personal estate what kind or nature soever, except moneys, to have and to hold the same during the term of her natural life. Fourth: I give and bequest to my said wife Margaretha Mosbacher the sum of one thousand dollars for her own use and benefit. Fifth: I give and devise to my said wife Magaretha Mosbacher my home place, where I now reside, being the Southeast half of Lots Number Thirty Five /35/ and Sixty Two /62/ in the Town of Columbia, in the County of Monroe and State of Illinois, to have and to hold the same during the term of her life, and after her decease to be divided as hereinafter ordered. Sixth: I give all the residue of my personal estate, consisting of money, notes or obligation to my son George Mosbacher, my grandson John Schmidt, the son of my deceased daughter Elisabeth Schmidt, to my son Nicholaus Mosbacher and to my daughter Maria Eva Hehl, to be divided between them equally, share and share alike, to be paid and delivered to them within one year after my decease. Seventh: I give and devise to my son George Mosbacher, my grandson John Schmidt, my son Nicholaus Mosbacher and my daughter Maria Eva Hehl all my real estate, hereafter described, to have and to hold the same from the date of the decease of my wife Margaretha Mosbacher unto them and their heirs, forever. Eighth: I appoint hereby my grandson John Schmidt as executor of this my last will and testament.
